The bug was fixes in the unstable branch. The fix was to ignore statically compiled init. However I couldn't find enough documentation, why init is ignored, or why the source change to the code has happened. The file that the code exists in fixup.c in linux-2.6-sparse-xen/arch/i386/kernel.
