This is the kernel, not the ramdisk which is what the error message
refers to.

Duh... bad copy paste sorry, I have the machine reverted to 3.8 now, and have no way to see that, the current one is:
16M Jan 11 Â2014 initrd.img-3.8.0-35-generic

The new ramdisk might be a little bit bigger but surely not much more and /tmp as ~ 10G free!
